Default Sahara City Homes - Zirakpur Chandigarh - Builder Woes

My father booked a flat in year 2000 with them with his life pension savings. He asked me whether he should pay full cost of flat. By intuition I guided him to stick with booking amount.

It has been 9 years. Not even a single brick is laid. We made the right decision and have got 3 lakhs stuck with booking amount!

but there are people who have paid in full amount.

I have opened this post to highlight the doings of sahara group.

Also to highlight that think twice before you give your money to any builder. Especially SAHARA Parivar.

Yesterday I read how DLF is returning money to 100 people who booked with them for DLF Chennai Flats. These 100 people started a google group and arrived together at builder premises in chennai and their demands were met!

I hope one day Sahara suffers will also get their act together and show up!

Default Consumer forum???

Some of my friends booked flats in Bangalore. The builder asks these people to get the next phase of loan disbursed as he does not have the funds to continue the construction. And the banks say that they will disburse the amount only if the builder completes the required percentage of construction. Kind of deadlock.

Would filing a complaint in the consumer forum help in such cases, where the builders dont stick to their promises?

Of course yes.

That's the best thing to do.

I have read quite a few articles where builders have been forced by consumer forums to return money with interest.

There's a catch here. In the agreement, the builder has included a clause which states that there might be deviations from the proposed plan. Every time these people ask him to progress as per the plan, he shows the clause and informs that they have signed it. So he claims that is legally immune. Are such clauses be legally valid?

Just because there is a clause in the agreement, doesn't mean it has to be legally valid.

It is best to approach the consumer court and let the court decide what is valid and what is not.

They are in talks with a lawyer. They will be approaching the consumer court very soon.

Its very sad these problems are being encountered mostly in real estate. Its a fact that Real Estate is unorganized yet most earning sector in India. Instead of making mistakes again & again, we should get aware of all the details that should be taken in consideration prior making any investment. One thing always sure your deal should get done by a reliable & trustworthy real estate service provider company, who generally guide on each & every step. And take projects only of reliable or promising builders. As a market research analyst i ll suggest everyone don't hesitate taking services of real estate service provider, which is famous for transparency, commitment & trust.
